No appearance by any of the defendants named in the complaint was made in the three-year period following the commencement of the action. On February 5, 1948, defendant served and filed a notice of motion to dismiss for lack of prosecution. The summons was filed with the clerk on February 6, 1948. The motion to dismiss was granted. Plaintiff appeals from the order of dismissal.
